Content Upload Terms and Conditions 1. Purpose and Formation of Agreement 1.1. Purpose

KOCHET allows users to upload, submit, or share photos, text, graphics, audio, video, location information, and comments (“User Content”) across KOCHET-operated digital properties. KOCHET may also use this User Content for marketing, promotion, advertising, editorial materials, and printed publications. To provide this service, KOCHET processes certain personal data from social media users and website visitors, including email address, images, IP address, location, usernames, timestamps, and transaction-related identifiers as described in the KOCHET Privacy Policy.

1.2. Formation of Agreement

When a user posts content on social media using the hashtag #KOCHET and mentions @KOCHET, KOCHET may request permission to use that content. By replying with the hashtag #KOCHET, the user grants KOCHET the right to upload, use, and process the content and related personal information. This response constitutes acceptance of KOCHET’s request, and these Terms and Conditions become binding.

2. User Content 2.1. Rights Granted to KOCHET

By submitting or tagging content, users grant KOCHET a perpetual, irrevocable, royalty-free, worldwide, non-exclusive license to use, reproduce, display, distribute, modify, edit, and create derivative works of User Content across KOCHET websites, social media channels, promotional materials, and any other media. Users also grant KOCHET permission to use identifying information, including name, username, likeness, image, and location. User Content is treated as public information unless covered by the KOCHET Privacy Policy.

2.2. User Representations and Warranties

Users warrant that they own all rights to the content submitted, have permission from any third parties appearing in the content, are legally allowed to submit the content, and that the content does not infringe copyright, trademark, privacy, publicity, or any applicable laws. Users assume full responsibility for the legality and accuracy of submitted content.

2.3. Waiver

Users waive the right to inspect or approve any materials in which their content appears, including promotional or finished products. Users also waive any rights related to licensing, sales, or royalties regarding KOCHET’s use of their content.

3. No Compensation

Users understand that KOCHET does not provide financial or other compensation for the use of User Content in KOCHET-operated digital properties or promotional materials.

4. KOCHET Intellectual Property

All KOCHET digital properties contain materials protected by copyright, trademark, and other intellectual property laws. Users do not obtain any ownership over KOCHET’s proprietary information.

5. Notice and Takedown Procedure

If a user believes their rights have been violated through User Content, they may submit a written notice to the KOCHET postal address. The notice must include identifying information, a description of the issue, exact location or description of the infringing content, and the reason the content is considered unlawful. KOCHET may remove the content upon verification and may notify the relevant parties.

6. Limitation of Liability

KOCHET is not liable for damages arising from User Content except in cases involving life, body, or health, or damages caused by gross negligence or intentional misconduct.

7. Indemnification

Users agree to indemnify and hold harmless KOCHET, its officers, employees, agents, partners, and third-party providers from any claims or damages arising from their User Content or violation of third-party rights.

8. Miscellaneous

These Terms constitute the entire agreement between KOCHET and the user. If any provision is deemed invalid, the remaining terms remain enforceable. These Terms are governed by Swiss law, with jurisdiction in Gangwon-do, Republic of Korea. All notices must be submitted in English and delivered through approved KOCHET communication methods.
